§1 Information on the collection of personal data

(1) In the following, we provide information about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior.

(2) The controller pursuant to Article 4(7) of the EU General Data Protection Regulation (GDPR) is MCM Menzel, Wasserrunzel 7-9, 91186 Büchenbach. You can contact our data protection officer at datenschutz@mcm-menzel.de or at our postal address.

(3) This data protection declaration applies to the website and the services offered by MCM Menzel, but not to other websites that the user may visit via links. Reference is made to the data protection provisions of the respective legal owners of these websites. In particular, we refer to the data protection provisions of Google Inc. for the use of the integrated map service Google Maps and Google Fonts.

(4) When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, possibly your name and telephone number) will be stored by us in order to answer your questions. We delete the data arising in this context after storage is no longer required, or restrict processing if there are statutory retention obligations.

§3 Collection of personal data when visiting our website

(1) If you use the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security. The legal basis for this is Article 6(1) sentence 1(f) GDPR.

These are the following data:

- IP address
- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code
- amount of data transferred in each case
- Website from which the request originates
- browser
- Operating system and its interface
- Language and version of the browser software.

(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard disk and assigned to the browser you are using and through which certain information flows to the relevant body that sets the cookie (in this case us). Cookies cannot execute programs or transfer viruses to your computer. They are used to make the website more user-friendly and effective overall.

a) This website uses the following types of cookies, the scope and function of which are explained below:

PHPSESSID - Session-Cookie - Will be deleted after closing.
PIWIK_SESSID - Matomo Session-Cookie - Will be deleted after closing.

– Persistent cookies (see c).

cookieconsent_status - Cookie notice response - Will be deleted after one year.
_pk_id.* - Matomo page ID - Will be deleted after one month.
_pk_ses.* - Matomo session cookie - Deleted after 30 minutes.
piwik_ignore - Matomo Opt-Out-Cookie - Will be deleted after two years.

b) Transient cookies are automatically deleted when you close the browser. These include session cookies in particular. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.

c) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies at any time in your browser's security settings.

d) You can configure your browser settings according to your wishes and, for example, refuse to accept third-party cookies or all cookies. We would like to point out that you may not be able to use all functions of this website.

e) We use cookies to identify you for subsequent visits if you have an account with us. Otherwise you would have to log in again for each visit.

f) This website uses the open source web analysis service Matomo. Matomo uses so-called “cookies”. These are text files that are stored on your computer and enable your use of the website to be analyzed. For this purpose, the information generated by the cookie about the use of this website is stored on our server. The IP address is anonymized before storage.
The information generated by the cookie about the use of this website is not passed on to third parties. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.
If you do not agree to the storage and use of your data, you can deactivate the storage and use here. In this case, an opt-out cookie will be stored in your browser that prevents Matomo from storing usage data. If you delete your cookies, the Matomo opt-out cookie will also be deleted. The opt-out must be reactivated when you visit our site again.

(4) For orders via our website or store system

You can only place orders via our website if you register as a company and are therefore commercially active. The advantage of registering is that you can log in to our store directly with your e-mail address and password when placing an order.

Your personal data is entered into an input mask and transmitted to us and stored. If you place an order via our website, we first collect the following data from the store:

  • Company name
  • Title, first name, last name,
  • a valid e-mail address with desired password and its confirmation
  • Address,
  • sales tax ID
  • Street and house number with zip code and town (you have the option of specifying a different delivery address)

This data is collected,

  • to be able to identify you as our customer
  • to process, fulfill and complete your order
  • to correspond with you;
  • for invoicing;
  • to process any liability claims that may exist and to assert any claims against you;
  • to ensure the technical administration of our website
  • to manage our customer data.

Your consent to the processing of this data is obtained as part of the ordering process.

The data processing takes place in response to your order and/or registration and is necessary for the purposes mentioned for the appropriate processing of your order and for the mutual fulfillment of obligations arising from the purchase contract in accordance with Art.6 Para.1 S.1 lit.b GDPR.

The personal data collected by us for the processing of your order will be stored until the expiry of the statutory retention obligation and then deleted, unless we are obliged to store it for a longer period of time in accordance with Article 6 (1) sentence 1 lit. c GDPR due to tax and commercial law storage and documentation obligations (from HGB, StGB or AO) or you have consented to further storage in accordance with Article 6 (1) sentence 1 lit. a GDPR.

(5) Forwarding of data

Your personal data will only be passed on to third parties by us to the service partners involved in the processing of the contract, such as the logistics company commissioned with the delivery and the credit institution commissioned with payment matters. However, in cases where your personal data is passed on to third parties, the scope of the data transmitted is limited to the minimum necessary.

§4 Objection or revocation against the processing of your data

(1) If you have given your consent to the processing of your data, you can revoke this at any time. Such a revocation affects the permissibility of the processing of your personal data after you have given it to us. The legality of the data processing carried out on the basis of the consent until the revocation remains unaffected by the revocation.

(2) Insofar as we base the processing of your personal data on the balancing of interests, you can object to the processing. This is the case if, in particular, the processing is not necessary for the performance of a contract with you, which is described by us in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done.
